This unit is responsible for ensuring state contractors implement and adhere to the state’s affirmative action policy. The unit’s overall responsibilities include conducting project-site reviews to ensure contractors are in compliance with the state’s affirmative action laws, including ensuring that contractors utilize minorities and women in the construction trades, and issuing certificates of compliance. Applicability: Vendors (Goods and Services Providers)
In accordance with Revised Code 125.111(B), all contractors from whom the State or any of its political subdivisions make purchases shall have a written affirmative action program for the employment and effective utilization of economically disadvantaged persons, as referred to in division (E)(1) of section 122.71 of the Revised Code. Annually, each such contractor shall file a description of the affirmative action program and a progress report on its implementation with the equal employment opportunity office (EOD) of the Department of Administrative Services.
Criteria for Affirmative Action Program Verification (AAPV):
Purchase from state agency or political subdivision of $2,500 or more
Certificate of Compliance Purpose: Pursuant to Revised Code 9.47, the purpose of the Certificate of Compliance (COC) is to determine if a contractor has complied with all federal and state affirmative action programs to which the contractor was subject pursuant to Revised Code 153.59.
Applicability: Construction Contractors No state or state assisted contract shall be entered into unless the bidder posses a valid Certificate of Compliance pursuant to Revised Code 9.47.
