If Your Claim Is Denied

If any party (you or your agency) disagrees with the Bureau of Workers' Compensation's decision on your workers' compensation claim, an appeal may be filed with the Industrial Commission. All appeals must be in writing and filed within 14 days of the issuance of a decision. The letter that you receive from BWC will inform you of your appeal rights. If you have questions concerning your appeal rights, contact BWC.

There are four levels in the appeal process. If you disagree with the decision, you may appeal your claim to the next level. The four levels occur in the following order:

  1. District Hearing Officer
  2. Staff Hearing Officer
  3. Industrial Commission
  4. Court of Common Pleas

You may represent yourself or be represented by an attorney at any level of the appeals process. Refer to your union contract or exempt employee handbook to determine your ability to take time off work to attend a hearing.
