Workers' Compensation: Legal Components

• Workers’ Compensation is a ‘no fault’ system.

• For a claim to be compensable (see ORC 4123.01 Section C):
  
  
  • The employee must have an injury or diagnosable illness
  • The injury or illness must be in the course of and arising out of employment

• Exclusions (see ORC 4123.01 Section C):

• Natural Deterioration
• Voluntary Recreation (Note: BWC Form C-159 should be completed to waive workers’ compensation coverage for voluntary participation in employer-sponsored recreational activities or fitness programs)
