Compliance Review

Purpose:

Ohio Administrative Code 123:2-5-02

The purpose of a post award compliance review is to determine if a contractor or subcontractor maintains nondiscriminatory employment practices and is exerting good faith efforts to accomplish the goals of an affirmative action program. It shall consist of a comprehensive analysis of the contractor’s or subcontractor’s employment policies and practices, including but not limited to, hiring, placement, training and promotion.

Post award compliance reviews shall include evaluation of the contractor’s or subcontractor’s employment and affirmative action records and existing state and non state project sites. The contractor or subcontractor shall provide at the agency’s request all records and support data pertaining to the contractor’s or subcontractor’s employment and affirmative action practices.

Note: The compliance review will be conducted at the company’s location. The following individuals should be present during a review: President or Owner and/or company’s designated EEO Officer and an EEO Contract Officer/Specialist from the State of Ohio, Equal Opportunity Division.


Selection Criteria

  • A contractor with 50 or more employees and a $50,000 state or state assisted contract; OR

  • A contractor with a $500,000 state or state assisted contract regardless the number of employees employed by the company.

Project Review

Purpose:

The Construction Compliance Unit conducts onsite visits on state and state assisted construction projects to interview contractor’s foreman/superintendent and field employees to ensure the following:

  • Prime and subcontractors are complying with the terms of the standard construction bid conditions relative to equal employment opportunity.

  • An environment free of discrimination, harassment and intimidation on state and state assisted construction project sites.

  • EEO posters and policies are visible in conspicuous locations on state and state assisted construction project sites.
